Acceptable Use Policy

1. Purpose

This Policy sets out the rules for using our AI Services safely, ethically and lawfully, and to protect the security and integrity of those systems, your data and the underlying AI models.

2. Prohibited Uses

You must not, and must ensure that your personnel and end users do not:

• (a)submit sensitive or protected health information, government identifiers (such as Tax File Numbers or Medicare numbers), or biometric data to any AI Service unless explicit data-handling provisions have been agreed in writing and the AI Service has been specifically configured for that purpose;
• (b)use the AI Services to make, or substantially inform, decisions that significantly affect an individual's rights or interests (for example credit, employment, housing or insurance decisions) without meaningful human review and oversight;
• (c)submit content that is defamatory, obscene, hateful, harassing or that infringes any third party's intellectual property rights;
• (d)attempt to reverse-engineer, decompile or extract model weights, or scrape outputs from the AI Services for the purpose of training competing models;
• (e)use the AI Services for any unlawful purpose or in breach of applicable Australian law, including the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth) and the Australian Consumer Law;
• (f)share login credentials, API keys or access tokens with unauthorised third parties;
• (g)probe, scan or test the vulnerability of any Evolve With AI system or network without prior written authorisation; or
• (h)use the AI Services to generate high-volume automated content intended to mislead, deceive or impersonate individuals or organisations, including non-consensual deepfakes, spam and disinformation.

3. Data Input Responsibilities

You are responsible for ensuring that all data submitted to the AI Services has been lawfully collected and that you hold the necessary rights and consents to process it through those services. Where an AI Service integrates with third-party providers, query data may be processed on third-party infrastructure as described in our Privacy Policy and Data Processing Agreement.

4. Human Oversight

AI-generated output may contain errors, biases or inaccuracies. You must maintain adequate human review before relying on any output in business-critical decisions, customer communications or regulatory filings. Our AI Services are tools that support human decision-making. They are not a substitute for professional judgement, legal advice or due diligence.

5. Monitoring & Enforcement

We may monitor usage patterns, API call volumes and input and output logs to detect and prevent breaches of this Policy, in accordance with our Privacy Policy. If we become aware of a breach, we may:

• (a)issue a warning and require remediation;
• (b)temporarily suspend access to the AI Services; or
• (c)terminate the relevant Service Agreement for material breach.

You will reimburse Evolve With AI for reasonable costs incurred in responding to a breach caused by you.

6. Reporting Violations

If you become aware of any misuse of the AI Services by your personnel or any third party, please notify us promptly at [email protected].

7. Updates to This Policy

We may update this Policy from time to time. Changes will be communicated by email or through the notice process in your Service Agreement. Continued use of the AI Services after a change takes effect constitutes acceptance of the updated Policy.

8. Governing Law

This Policy is governed by the laws of New South Wales, Australia.
